Example of posting having started before 30 July 2020.

A worker is effectively posted to Belgium from 1^st October 2019 to 15 March 2021 inclusive.
Such a period shall cover one single posting.

In order to determine whether the duration of the posting of this worker actually exceeds twelve months, account will be taken of the work performed by the worker from 1^st October 2019 to 29 July 2020 (in addition to those completed from 30 July 2020).
Such posting will therefore be considered as effectively exceeding 12 months on 1^st October 2020.

The general scheme on working conditions will therefore be applicable to the work performed by the posted worker from 1^st October 2019 to 30 September 2020 inclusive.

The employer of the posted worker will therefore be obliged to apply from 1st October 2020 the special scheme.
