Application for derogation regarding the use of chemical agents

The application

Companies that wish to submit an application for derogation regarding the use of chemical agents preferably send this by email to hua@werk.belgie.be (or by post: FOD Werkgelegenheid, Arbeid en Sociaal Overleg, Algemene Directie Humanisering van de Arbeid, Ernest Blerotstraat 1, 1070 Brussel). To do so, complete the application form, which is available on the website of FPS Employment.

The application must be signed (electronically or otherwise) by a person charged with the management and organisation of the company.

The application is free of charge.

The application procedure is available in Dutch, French and English.

Processing of the application

The application is submitted for assessment to the General Directorate for Monitoring the Well-Being of Workers in the Performance of their Work (TWW), after which the deviation will be granted or denied by Ministerial Decree.

The time between the submission of the application and the decision whether or not to grant the derogation is on average 3 to 6 months. This processing time is an estimate and depends on the completeness and complexity of the application.

Appeal against the decision taken

If the decision is contested, an appeal for annulment (and a request for suspension) may be lodged with the Administrative Jurisdiction Division of the Council of State, in accordance with the procedure laid down in the Decree of the Regent of 23 August 1948, regulating the proceedings before the Administrative Jurisdiction Division of the Council of State.
