Application for accreditation
The company that wishes to submit an application for accreditation or renewal of accreditation preferably sends this by email to hua@werk.belgie.be (or by post: FOD Werkgelegenheid, Arbeid en Sociaal Overleg, Algemene Directie Humanisering van de Arbeid, Ernest Blerotstraat 1, 1070 Brussel).
The following attachments must be enclosed with the application:
- the copy of the director's diploma; in the event of reasonable doubt as to the truthfulness of the copy of this document presented or submitted, the procedure provided for in Article 508, § 2 and § 3, of the Programme Act of 22 December 2003 must be applied;
- the director's curriculum vitae;
- the copy of proof of accreditation NBN EN ISO/IEC 17020;
- a declaration that the EDTC's civil liability is covered by an insurance contract.
The application must be signed (electronically or otherwise) by a person charged with the management and organisation of the company.
The application is free of charge.
The application procedure is available in Dutch, French and English.
Processing of the application
The General Directorate for Humanisation of Labour will issue advice on the application to the Minister within 60 days of determining the completeness of the file.
When an EDTC applies for accreditation for the first time without having been granted previous accreditation or when an extension of the scope of accreditation is requested (without the accreditation having been extended previously), the General Directorate for Humanisation of Labour reports to the Permanent Operational Committee within the High Council for Prevention and Protection at Work. This committee assesses the application and advises the Minister.
The Minister decides on the accreditation of the external service for technical inspections at the workplace: accreditation can be granted, partially granted, granted for a limited period, or refused.
Where accreditation is granted in part or refused, the applicant may submit their objections within 30 days of receipt of the decision. The General Directorate for Humanisation of Labour will transfer the file to the Permanent Operational Committee within 60 days of receipt of the objections, which advises the Minister on the application. The Minister makes a final decision.
Accreditation is granted for a limited period of 3 years when the application for accreditation is from an EDTC applying for accreditation for the first time or when an extension of the scope of the accreditation is requested.
A sanction mechanism is also provided, which means that accreditation of an external service for technical inspections that does not comply within the time limit imposed may be limited or withdrawn, or that only provisional accreditation may be granted.
The time between the submission of an application for accreditation and the decision whether or not to grant accreditation is on average 6 months. This processing time is an estimate and depends on the completeness and complexity of the application.
Appeal against the decision taken
If the decision is contested, an appeal for annulment (and a request for suspension) may be lodged with the Administrative Jurisdiction Division of the Council of State, in accordance with the procedure laid down in the Decree of the Regent of 23 August 1948, regulating the proceedings before the Administrative Jurisdiction Division of the Council of State.
