Posting - access to the territory and stay

    Registration at the municipal administration of the place where the posted worker is staying in Belgium

    A distinction has to be made between, on the one hand, postings which do not exceed 90 days and, on the other hand postings exceeding 90 days

    1) Posting in Belgium which does not exceed 90 days 

    Two situations can arise

    CASE 1 The posted worker is a national of a Member State of the European Economic Area (EEA), a Swiss national or a British national.

    This posted worker must register at the municipal administration of the place where he/she is staying in Belgium, within the ten working days of his/her arrival in Belgium. 

    NB ! : exception : where the posted worker is staying in an hotel or any other accomodation subject to the legislation regarding hotels, he/she is exempted from such an obligation regarding this presence declaration.

    CASE 2 The posted worker is neither a national of a Member State of the European Economic Area (EEA) nor a Swiss national, nor a British national.

    This posted worker must register at the municipal administration of the place where he/she is staying in Belgium, within the three working days of his/her arrival in Belgium. 

    NB ! : exception : where the posted worker is staying in an hotel or any other accomodation subject to the legislation regarding hotels, he/she is exempted from such an obligation regarding this arrival declaration.

    2) Posting in Belgium exceeding 90 days 

    Two situations can arise

    CASE 1 The posted worker is a national of a Member State of the European Economic Area (EEA), a Swiss national or a British national.

    This posted worker, in addition to his/her presence registration, must submit at the municipal administration an application for residence of more than 90 days, at last within the 90 days of his/her arrival in Belgium.


    CASE 2 The posted worker is neither a national of a Member State of the European Economic Area (EEA) nor a Swiss national, nor a British national.

    This posted worker must submit, within the first 90 days, an application for residence of more than 90 days to the mayor of the municipality where he/she is staying. 

    In this case, the posted worker must be able to produce his/her work permit or to prove that he/she is exempted from such a work permit formality.
